Car Accident Lawyers Cairns & Townsville

You could be entitled to claim compensation if you were injured in a car accident, regardless of whether you were a driver, passenger, pedestrian, or even a cyclist.

All vehicles in Queensland are required by law to have Compulsory Third Party (CTP) Insurance, along with being registered. CTP Insurance covers compensation for anyone injured in a motor accident in the state.

Of course, if you were the one who caused the accident, you will not be entitled to compensation.

Determining who is at fault in a road or car accident in a legal sense can sometimes be quite complicated for car accident compensation claims. Provided an experienced compensation lawyer can properly do this to the CTP Insurer or Court’s satisfaction, you will be entitled to claim for compensation.

Timeframes

There are strict time limits that apply to motor vehicle accident claims. In most cases, you must lodge your injury claim within nine (9) months from the date of the accident, or within one (1) month of consulting a law firm, whichever is earlier. If you fail to lodge your claim within these timeframes, you may still be able to lodge your injury claim however you must also provide a Notice of Reasonable Excuse for Delay.

In Queensland, you must issue proceedings or extend the limitation period within three (3) years from the date of the accident. If you do not do so, you will be barred from proceeding with a claim for compensation.

It is important to note that these timeframes also differ for motor vehicle accident claims where the at-fault vehicle is unable to be identified or is unregistered. In most cases, you must lodge your injury claim against the Nominal Defendant within three (3) months from the date of the accident, or within one (1) month of consulting a law firm, whichever is earlier. If you fail to lodge your claim within these timeframes, you may still be able to lodge your injury claim within nine (9) months from the accident date however you must also provide a Notice of Reasonable Excuse for Delay. If you do not lodge your claim within nine (9) months from the accident date, you will be barred from proceeding with a claim for compensation against the Nominal Defendant.

It is recommended to consult an experienced car accident lawyer to know which time limits apply to your claim.
